Date: Friday, February 19th at 11:00 am.
Pursuant to Orders in the US Bankruptcy Court, case No.
09-04294-hb, Cheeks Auction Company has been authorized to sell this property AS ONE LOT,
to the Highest Bidder, Regardless of Price.
Inspection: Thursday,
Feb 18th from 8:00am until 11:00 am and beginning at 8:00am on
Friday, Feb 19, 2010
Registration: All bidders MUST pre-register, provide certification of funds, and be approved
by the auctioneer prior to the beginning of the sale. Potential bidders must complete
pre-registration forms prior to the auction AND are required to provide a bank letter of credit or evidence of certified funds prior
to the auction. No exceptions and
strictly enforced by auctioneer.
Payments: Cash, Cashier’s check, or certified check
with a Bank Letter of Gaurantee .

10% Payment
due in CASH from the highest bidder immediately at the end of the auction. Remainder of balance is due within 72 hours
of the end of the auction and must be either CASH, certified check, or
cashier’s Check.

The
Successful bidder will be required to pay a non-refundable CASH deposit in the
amount of ten percent (10%) of the sales price at the time of auction..
The balance must be in the form of Cash,
certified check, secured funds, or
business check accompanied by a Bank Letter of Credit. . The balance of the payment will be required
within 72 hours after the end of the auction.

In the event that full payment cannot be
obtained by the high bidder, the auctioneer has the right to sell the property
to the back-up bidder without re-bidding or re-advertising the sale
Removal
of equipment: All
equipment and property must be removed from the premises within 7 Days of the
conclusion of the auction. No merchandise may be removed from
the auction site until all funds are received by the auctioneer. Removal
of the equipment is the responsibility of the buyer. Electrical equipment must be disconnected by
a licensed electrician using approved methods and termination points (junction
box, panelboard, etc). Plumbing and piping will be properly terminated at the
nearest fitting or fixture approved by the auctioneer.
NO BUYER’s PREMIUM. State and local sales tax
of 7% will be charged unless Buyer provides copy of Business License and
provides an exemption certificate for resale purposes. (SC tax form ST-8 and ST-8A).
